Confidentiality

Federal privacy requirements for protected health information generally exclude student health information. Dickinson State University complies with all applicable laws and professional standards pertaining to the privacy of client information. Dickinson State University recognizes that confidentiality is essential to effective treatment. In order to facilitate treatment, a client must feel safe about sharing personal information with the counselor.

All Dickinson State University records are confidential and do not become part of general University records. In most cases, no information about a client may be released without the client’s written consent authorizing the release of information.

There are some exceptions where the minimum amount of information necessary will be shared without a client’s written consent. Examples of such circumstances may include the following:

  • If there is a reasonable suspicion that a client may be in imminent danger of harming self or someone else. This may include notifying family members or another emergency contact, contacting the police, and contacting local mental health crisis teams. If a situation like this should occur, every effort will be made to fully disclose the situation with the client before taking any action.
  • If a client discloses the abuse or neglect of a child, an elderly person or a person with a disability.
  • If documents are ordered by a court of competent jurisdiction. The documents will be released only to the custody of the court.
  • If it is necessary for the Counseling Office to make a referral on the client’s behalf to Student Health or other healthcare facilities in order to coordinate treatment.
  • To members of DSU’s Behavior Intervention Team (BIT) when there is information that involves a threat of harm to self or others. Only relevant and pertinent information will be shared.
  • If there are legal or regulatory actions against a DSU employee.
  • DSU and the Counseling Office may use student information for the purpose of program evaluation according to the Family Education Rights and Privacy Act (FERPA). No specific treatment information will be provided for purposes of program evaluation.
